The parties hereto were married early in the year 1948 in Heidelberg, Germany. A divorce was granted to the plaintiff in the circuit court for Eau Claire county on August 2, 1949. At that time the parties had an infant daughter, Jean, then only a few weeks old. In May, 1950, the plaintiff made application to the court for change of custody of the daughter, which was denied. In August, 1950, the defendant married Stanley Pinck, and in September, 1950, the plaintiff again made application for a change in the custody of the child. This application was also denied. In February, 1954, each party made an application to the court for an amendment of the judgment of divorce, the mother seeking permission to take the child to Minneapolis, Minnesota, where her husband had been transferred by his employer, and the plaintiff again applying for a change of custody. Apparently each acted independently of the other, and their respective applications were consolidated for hearing.
